Legal Services NYC, Legal Aid, and Selendy Gay Secure SCOTUS Order in Final Two Rent Stabilization Law Cases

November 12, 2024
SCOTUS

(NEW YORK, NY) – Legal Services NYC, The Legal Aid Society, and Selendy Gay PLLC, along with the NY Attorney General’s office, secured a U.S. Supreme Court order which denies the landlords’ petitions for certiorari in Building and Realty Institute Of Westchester and Putnam Counties, Inc., et al. v. State Of New York, et al. and G-Max Management, Inc., et al. v. State Of New York, et al. The order leaves in place the Second Circuit rulings that upheld the Housing Stability and Tenant Protection Act of 2019 (HSTPA) and New York’s Rent Stabilization Law (RSL).

Today’s action follows decisions by the United States Supreme Court to decline to review three prior Second Circuit rulings dismissing lawsuits by landlord groups challenging New York’s long-standing Rent Stabilization Laws.

In response, Legal Services NYC, Legal Aid, and Selendy Gay PLLC, stated:

“Today’s decision preserves the unanimous Second Circuit rulings which found that these lawsuits were always wrong on the law and devoid of merit. Since 1969, New York’s Rent Stabilization Law has provided affordable housing for millions of New Yorkers, preventing displacement and combating homelessness, and we will continue to challenge any and all efforts aimed at eroding the well-established and lawful protections that the communities we serve rely on.”
